Bank of America/Countrywide have been trying to foreclose on my since shortly after I became disabled in 2007.

Needless to say BOA has tried every dirty trick in the book.

Yesterday I thought I would take another look at the note and deed. On a hunch I decided to call the Virginia State Corporation Commission about the lender.

***I was informed that the lender on my note "No Longer Exists" and hasn't for 10 years.

I already knew this but the documents also state that MERS is the beneficiary.

Does anyone have any thoughts on this scenario?

The obvious first question is if BOA is trying to take your home, is the Note endorsed to them or in blank? Because if it is, then the original lender is of no consequence.

The NOTE shows the lender as Sterling Capital Mortgage and the beneficiary as MERS.

The Virginia Corporation Commission states that Sterling has not existed since 2005 and can't do business in VA since the same time.

No big bank names anywhere.

BOA has robo signed a transfer of deed from MERS to BOA for the benefit of Sterling 5 years after Sterling ceased to exist.

ROBO Signatures:

Debbie Nieblas

Edward Galagos

Both signed as MERS representatives and I read that Debbie Nieblas works for BOA?

I don't have any personal experience with MERS but I seem to remember recent cases like you are talking about, in the Legal Lounge. Not sure how far you have made it around the site so forgive me if this is too obvious.

On the main page there is a menu on the left. Click "Law Library". Then in the middle of the next page there are buttons, one is the "Legal Lounge". There is a ton of information in there about MERS. Hopefully someone with experience with them can help more. Good luck.

It doesn't seem to matter.. Check your recorder's link.. You'll find 1000's of transfer's from non existent banks to whomever they like.. Taylor bean/Wachovia/Wamu... They don't care... and the court are allowing it..

it is flat out THEFT and it is absolutely unbelievable the unethical/unlawful acts I have proven with solid facts, (cancelled checks, documents stating one thing that is contradicted by the next document and on and on), to federal agencies and no one will do anything.

THIS IS NOT THE COUNTRY I GREW UP LOVING. It is now a sham and a game of slight of hand on the American people.
